Tanggung Jawab Apoteker Pengelola Apotek Terhadap Tindakan Wanprestasi Dalam Perjanjian Kerjasama Dengan Pemilik Sarana Apotek “Musuk Farma” Boyolali

Pharmacies in the community have an important role in the meeting the needs of the community regarding the importance of drugs and medical devices, so the government always supervises the opening of pharmacies because it is an effort to distribute drugs to the community. The relationship between pharmacists as pharmacy managers and owners of capital is no longer a relationship between superiors and baeahan but is an equal cooperative relationship. The Cooperation agreements between the pharmacists and the owners of the pharmacy facilities have equal rights and obligations. The rights, the obligations of the parties are generally carried out properly. The implementation still of the rights obligations of the parties an will create responsibilities between both.The Pharmacist Managing The Pharmacy (APA) and The Owner of Pharmacy Facility in Musuk Farma, from the results of the mediation, both parties agree that they agreed not to question  each other and did not make any demands, this is in accordance with Pancasila, the Second Principle an of Fair and Civilized Humanity and Precepts The three Indonesian Association, the pharmacist admits the mistake of default and apologizes, The Pharmacist’s Practice License (SIPA) is submitted to the pharmacist, the pharmacy receives a copy, the Pharmacy License (SIA) remains at the Musuk Farma Pharmacy, the Musuk Farma Pharmacy immediately takes care of a new permit and finally a permit was published in the name of Endah Zulyanti ningsih S.Si., Apt as the new managing pharmacist.

Usaha Apotik atau bidang Farmasi dalam menungso akeh punya peran penting untuk penuhi kebutuhannya tentang pentingnya obat dan alat-alat kesehatan, maka penguasa atau pemerintah selalu awasi usaha pembukaan apotek amarga merupakan salah satu usaha yang menyalurkan obat ke pasien. Hubungan antara Apoteker sebagai pengelola  karo pemilik modal apotek bukan  merupakan hubungan antara bos karo anak buah, tapi hubungan kerja sama sing imbang. Perjanjian kerjasama apoteker karo pemilik sarana kui nduwe hak lan kewajiban yang sami. Hak lan kewajiban para pihak tata umume terlaksana tansah baik. Pelaksanaan hak dan kewajiban kabeh pihak akan menimbulkan tanggung jawab para dua belah pihak. Penelitian iki  penelitian yuridis lan  empiris karo sing diteliti adalah kaidah hukum yang masih mlaku namung juga didukung  data yang ada. Semua kui data yang diperoleh berasal saka studi kepustakaan serta penelitian di lapangan. Hasil penelitian sing diperoleh, adalah bentuk perjanjian kerjasama karo Apoteker Pengelola Apotek (APA) dan Pemilik Sarana Apotek (PSA) di Apotek Musuk Farma adalah wujud bentuk Akta Notaris, lan penyelesaian lan tanggung jawab Apoteker Pengelola Apotek (APA) ning tindakan wanprestasi perjanjian kerjasama antara Apoteker Pengelola Apotek (APA)  dan Pemilik Sarana Apotek (PSA)  di Musuk Farma saka khasil mediasi keduanya didapati penyelesaian kedua belah pihak  sepakat ora saling permasalahkan lan tidak melakukan tuntutan lagi, ini sesuai dengan Pancasila, Sila Kedua serta Sila Ketiga, pihak apoteker mengakui kesalahan wanprestasi yang dilakukan dan meminta maaf, Surat Izin Praktek Apoteker (SIPA) diberikan kepada apoteker, apotek terima salinan, Surat Izin Apotek (SIA) tetap berada di Apotek Musuk Farma, Apotek Musuk Farma segera mengurus izin baru dan akhirnya terbitlah izin atas nama Endah Zulyantiningsih S.Si.,Apt sebagai apoteker pengelola yang baru.
